Terms of Service

These terms govern your use of pitchtwin.ai, the dashboard and the API (the “Service”) provided by PitchTwin (“we”, “us”). By creating an account or using the API, you agree to them on behalf of yourself and the organization you represent (“you”).

1. The Service

PitchTwin generates videos of a real person speaking a script, using footage and voice samples you provide. The Service is intended for businesses. You must be at least 18 and able to enter into a contract.

2. Your account

Keep your login details and API keys confidential. You are responsible for all activity under your account and keys. If you suspect a key has leaked, revoke it in the dashboard and tell us at pitchtwinsupport@gmail.com.

3. Consent and acceptable use

This is the most important section. You may only create avatars and videos of a person if:

  • that person has given you explicit, informed and documented consent to be recorded, to have an avatar of their face and voice created, and to have videos generated with it for your purpose;
  • you can show that consent to us on request; and
  • you stop using the avatar and ask us to delete it if the person withdraws consent.

You must not use the Service to:

  • impersonate anyone, or make it look like someone said something they did not agree to say;
  • create deceptive political content, fake endorsements or testimonials, or fraud such as scams and phishing;
  • create sexual content, harassment, hate speech, or any content involving minors;
  • break the law, including privacy, publicity, consumer-protection and intellectual-property law;
  • try to reverse-engineer, overload or resell raw access to the Service except as part of your own product.

Where the law or the platform you publish on requires it, you must disclose to viewers that a video was AI-generated. We may suspend accounts or remove content that breaks this section, without refund.

4. Your content

You keep all rights to the footage, voice samples and scripts you upload, and to the videos we generate for you. You give us a limited license to process them solely to provide the Service to you. We do not use your content to train models offered to other customers. Our handling of personal data is described in the Privacy Policy.

5. Tokens and payment

  • The Service is paid for with prepaid tokens. One token equals one second of generated video. Prices are shown on our website and in the dashboard.
  • Payments are processed by Stripe. Tokens are added to your balance once payment succeeds.
  • Tokens do not expire while your account is open. They have no cash value and cannot be transferred.
  • Token purchases are non-refundable, except where the law requires otherwise or a generation failed because of us. In that case we return the tokens used.
  • Unused tokens are forfeited if you delete your account or it is terminated for breach of these terms.
  • We may change prices for future purchases. Tokens you already bought are not affected.

6. Availability and changes

We work to keep the Service available, but we provide it “as is” and do not guarantee it will be uninterrupted or error-free. We may change or discontinue features. If we discontinue the whole Service, we will give reasonable notice and refund unused tokens.

7. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, such as lost profits or lost data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

You will indemnify us against claims from third parties arising from content you submit or from your breach of Section 3, including claims by people who appear in your videos.

8. Ending the agreement

You can stop using the Service and delete your account at any time in Dashboard → Settings. We may suspend or close your account if you seriously or repeatedly breach these terms.

9. Changes to these terms

We may update these terms. If the changes are significant, we will notify you by email at least 14 days before they take effect. If you keep using the Service after that, you accept the new terms.
